The DMCA can be a powerful tool to combat online infringement because it requires an Online Service Provider (OSP) such as Amazon, GooglePlay, AppStore, and others to take clear and express steps upon receipt of notice of infringement or potentially face monetary damages along with the actual infringe party whose product is hosted on the site. The DMCA provides safe harbor to OSP’s who comply, which helps protect users and rightful brand owners from unlawful infringement online.
The Lanham Act: This statute governs trademark law in the United States. It provides the legal framework to protect brands and trademarks from infringement, false advertising, and unfair competition.   • A statement of good faith.
  • Contact information and the signature of the authorized party making these demands.

(3) The Official CEASE and DESIST Letter: If the infringing party fails to respond or remove the content, we escalate the matter by sending an official CEASE and DESIST letter. This letter contains more extensive explanations of the elements mentioned in the TAKE-DOWN letter and cites applicable statutes.
