Electronic Video Games Attorneys Mobile Gaming Law Attorneys

The Bayne Law Group is dedicated to providing a full spectrum of legal services to inventors and businesses engaged in the electronic video gaming industries, representing and looking after our clients in the electronic video games sectors. Our firm’s video game lawyers want to help companies successfully navigate video game contract law.

We have considerable knowledge of the complex copyright and contract rights involved in negotiating with large-scale electronic gaming industry corporations. Our goal is to assist developers, publishers and owners of original video gaming content throughout the regulatory framework, IP protection structures and complex litigation arena surrounding this highly complex and global electronic games industry.

Original video games are Recognized as Original Works under the United States Copyright and other international laws as Protected Intellectual Property.

Video gaming legal rights and industry protections have been developing since Sega’s Periscope, possibly the first 25 cent arcade game in the United States. Although, Atari’s Breakout was not recognized as a copyrighted work until 1992 in Atari Games Corp. v. Oman, 979 F. (2d) 242 (Cir DC 1992), through legal case law development following the recognition of Periscope, the U.S. Court of Appeals for the Second Circuit in Stern Electronics Inc. v. Kaufman, 669 F.2d 852 (2d Cir. 1982) ruled that a video game manufacturer, Stern Electronics, could copyright the images and sounds in a game, not just the underlying source code that produced them.

Since Brown v. Entertainment Merchants Association, 564 U.S. 08-1448 (2011), the landmark United States Supreme Court case that struck down a 2005 California law banning the sale of certain violent video games to children without parental supervision, video games have also been recognized as protected speech under the First Amendment along with many other media.

Bayne Law Group supports independent developers and designers in developing a tailored intellectual property protection plan for video game designers, producers and organizations as well as providing representation and negotiation of original video games sale or licensing of design rights to commercial video game distributors. Our legal support also provides protection for players in competitive video game contracts.
