U.S. Business Immigration Visa Lawyers | EB1 and EB2 Visas

The EB1 visa is a first-preference visa as defined by the Immigration and Nationality Act (INA). As a first-preference visa, it provides preferred status for workers who meet its eligibility requirements. EB1 visas do not require labor certification from the Department of Labor.
The EB1 visa is for priority workers, which include:
- Persons with extraordinary ability
- Outstanding professors and researchers
- Multinational managers or executives
The INA defines extraordinary ability as unique talent in the sciences, arts, education, business or athletics. Professors and researchers must be internationally recognized, meet other selective criteria and have a prospective employer willing to file an immigrant petition for alien worker, form I-140, with the USCIS.
Pursuant to INA section 203(c), multinational managers or executives from overseas must be transferring to the U.S. for work as managers or executives and must have recently worked for the company from which they are transferring. The U.S. company that the manager or executive seeks to transfer to must be the same company, a subsidiary or an affiliate of the overseas company.
The EB2 visa is a second-preference visa that generally requires labor certification. Workers eligible for the EB2 include:
- People with exceptional ability
- People with advanced degrees
Exceptional ability may be demonstrated in the sciences, arts or business. The INA defines an advanced degree as something more than a baccalaureate degree, or a baccalaureate degree plus several years of requisite experience.
